These Terms of Use (“Terms”) govern your use of the website treehouseindoorplay.com, operated by Treehouse Family Entertainment Group Holdings LLC and its affiliated location entities (“Tree House,” “we,” “us,” “our”), including browsing the site, booking a visit or party, purchasing a day pass, membership, or gift card, and any other feature we offer online.

By using our website, you agree to these Terms. If you don’t agree, please don’t use the site. These Terms don’t replace the liability waiver you sign (electronically, through our booking platform) before visiting one of our locations — see Section 3.

1. Use of the Website

You may use our website to learn about Tree House, book visits, parties, and memberships, make purchases, and contact us. You agree not to:

• Use the site for any unlawful purpose or in a way that could damage, disable, or impair it
• Attempt to gain unauthorized access to our systems, accounts, or data
• Copy, scrape, or reuse our content for commercial purposes without our written permission
• Post or transmit anything false, misleading, harassing, or infringing on someone else’s rights
• Impersonate another person or misrepresent your affiliation with anyone

We may suspend or restrict access to the site for anyone who violates these Terms.

2. Bookings, Purchases & Our Booking Platform

Day passes, memberships, birthday party bookings, and gift cards are sold and processed through our online booking platform (Roller), which has its own terms and privacy policy governing checkout and payment. By purchasing through that platform, you also agree to its terms.

• Pricing is as posted at checkout and may change at any time; the price at the time of your purchase applies to that purchase.
• Memberships renew automatically each billing period until cancelled; cancellation requires the written notice period stated at sign-up (currently 7 days).
• Cancellations, rescheduling, and refunds for day passes, parties, and memberships follow the policy shown at booking; contact us at hello@treehouseindoorplay.com with questions about a specific booking.
• Gift cards are non-refundable and can be used at any Tree House location unless stated otherwise.

3. In-Person Waivers and Assumption of Risk

Browsing this website and booking online does not by itself waive any legal rights. Before you or your child may play at a Tree House location, every adult and child must have a signed waiver on file (completed digitally through our booking platform), which includes an assumption-of-risk and liability release specific to indoor play activities.

These Terms of Use govern the website. The waiver you sign is a separate legal document that governs your visit and play at our locations, and its terms control in the event of any conflict regarding on-site activities.

4. Intellectual Property

The Tree House name, logo, jungle-themed branding, website content, photos, and design are owned by Tree House or used under license, and are protected by trademark and copyright law. You may view and share content from our site for personal, non-commercial use, but may not reproduce, modify, or use it commercially without our written permission.

5. User Content, Reviews & Photos

If you submit a review, comment, photo, or other content to us (directly or by tagging us on social media), you grant Tree House a non-exclusive, royalty-free right to use, reproduce, and share that content in our marketing, including on our website and social channels, unless you tell us otherwise. You’re responsible for making sure you have the right to share what you submit, including consent for any child pictured who isn’t your own.

We may remove any user content at our discretion, including anything false, offensive, or that violates someone else’s rights.

6. Third-Party Links

Our site links to third-party services we don’t control, including our booking platform (Roller), payment processors, and social media pages. We aren’t responsible for the content, terms, or privacy practices of those sites, and linking to them doesn’t mean we endorse them.

7. Disclaimer of Warranties

Our website and its content are provided “as is,” without warranties of any kind, express or implied, including accuracy, availability, or fitness for a particular purpose. We try to keep pricing, hours, and availability current, but we don’t guarantee the site is always error-free or uninterrupted.

8. Limitation of Liability

To the fullest extent allowed by law, Tree House and its owners, employees, and affiliated location entities aren’t liable for any indirect, incidental, or consequential damages arising from your use of the website. This section addresses use of the website only — liability related to physical injury at our locations is governed by the liability waiver you sign before playing, not by these Terms.

9. Indemnification

You agree to indemnify and hold Tree House harmless from any claim or expense (including reasonable attorneys’ fees) arising from your misuse of the website or violation of these Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the website will be handled in the state or federal courts located in Broward County, Florida, and you agree to that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We’ll post the revised version here with a new effective date. Continuing to use the website after a change means you accept the updated Terms.
